1. About these Terms & Conditions
These Terms & Conditions govern the use of the Lerhema Cleaning Ltd website and, where applicable, the provision of cleaning services to residential and business customers.
In these terms, “Lerhema Cleaning”, “we”, “us” and “our” refer to Lerhema Cleaning Ltd. “You” and “your” refer to a website visitor, customer or other person using our services.
Different terms may apply to particular services where they are agreed with the customer in a written quotation, booking confirmation, service agreement or other contract.
These terms must be read alongside any applicable service-specific agreement.
2. Our services
Lerhema Cleaning Ltd may provide cleaning services to residential and commercial customers, subject to availability and the terms agreed for each booking.
Services may include domestic cleaning, commercial and office cleaning, healthcare or care-sector cleaning, end-of-tenancy cleaning, short-term accommodation cleaning, post-construction cleaning and other specialist cleaning services offered by us.
The services available, their scope and any applicable limitations will be confirmed through the relevant quotation, booking confirmation or written agreement.
Not every service will necessarily be available in every location or at every time.
3. Quotations and bookings
A request for a quotation does not automatically create a contract.
Unless otherwise stated in writing, quotations are based on the information provided by the customer, including the property or premises, the requested tasks, the required frequency and any special requirements.
Before accepting a quotation, customers should check the scope of work, price, applicable taxes, service date, duration, exclusions and any additional charges stated in the quotation.
A booking is confirmed when we have accepted it in writing or through another agreed confirmation method.
We may need to revise a quotation if material information was missing or circumstances differ significantly from those described when the quotation was prepared. Any proposed change to the price or scope must be communicated to the customer for agreement before the additional work is undertaken, except where an immediate action is reasonably necessary for safety or to prevent damage.
4. Prices and payment
The applicable price and payment arrangements will be set out in the relevant quotation, invoice or written agreement.
Unless otherwise agreed in writing:
-
Payment is due in accordance with the invoice or agreed payment schedule.
-
Customers should use the payment details provided on the legitimate invoice.
-
Customers should contact us promptly if an invoice appears incorrect.
-
Any agreed additional work may result in an additional charge, provided the charge is disclosed and agreed as required.
Payment methods currently expected to include invoices and bank transfers are subject to confirmation in the relevant agreement.
[INSERT STANDARD PAYMENT DEADLINE, VAT STATUS IF APPLICABLE, AND ANY AGREED DEPOSIT OR LATE-PAYMENT ARRANGEMENTS.]
For business customers, any applicable late-payment rights or charges will be applied only where legally permitted and properly agreed or otherwise authorised by law.
For consumers, charges and payment terms will be transparent and will not override statutory rights.
5. Customer responsibilities
To help us provide the agreed service, customers must, where relevant:
-
Provide accurate information about the property, premises and requested cleaning tasks.
-
Ensure that we can safely access the agreed work area at the scheduled time.
-
Disclose known hazards or special requirements that could affect safe service delivery.
-
Secure valuables and personal belongings appropriately.
-
Inform us of any relevant restrictions on access, products or cleaning methods.
-
Ensure that electricity, water and other facilities necessary for the agreed service are available, where applicable.
-
Ensure that pets, occupants, employees and visitors can remain safe while cleaning is carried out.
Customers must not ask our personnel to undertake work that is unsafe, unlawful or outside the agreed service.
If access is unavailable or the premises are unsafe, we may need to delay, suspend or reschedule the work. Any resulting charge must be consistent with the agreed terms and applicable law.
6. Our responsibilities
We will use reasonable care and skill when providing agreed cleaning services and will comply with applicable legal requirements.
We will aim to perform the agreed work within the scheduled timeframe. However, timing may be affected by matters outside our reasonable control, including access problems, unexpected conditions at the premises, emergencies or equipment failures.
If a problem arises, we will seek to communicate with the customer and agree an appropriate solution.
Nothing in these terms excludes or restricts any duty or liability that cannot lawfully be excluded or restricted.
7. Scope of work and additional services
Our responsibility is limited to the tasks agreed in the applicable quotation or service agreement, subject to statutory obligations.
Unless expressly included, a cleaning service does not automatically include repairs, waste removal, specialist restoration, pest control, hazardous-material removal, maintenance or other specialist work.
Customers should identify any particular outcome they require before accepting a quotation. We cannot guarantee the removal of every stain, odour, mark or deposit where the result depends on the condition, age or nature of the affected material.
Any extra work must be agreed before it is undertaken.
8. Health, safety and specialist cleaning
We may decline or suspend work where the conditions present an unacceptable safety risk or where the requested work requires specialist authorisation, training, equipment or procedures that are not available.
Customers must disclose known risks relevant to the service, including significant contamination, sharps, hazardous substances, structural hazards or other dangerous conditions.
For healthcare, care-sector and other specialist environments, the scope of service, access arrangements, confidentiality requirements, infection-control measures and any applicable standards should be specified in the relevant contract.
9. Changes, rescheduling and cancellations
The cancellation, rescheduling and notice arrangements for each service will be those stated in the applicable quotation, booking confirmation or written agreement.
Customers should submit cancellation or rescheduling requests to info@lerhema.com or through the contact method specified in their booking confirmation.
Where a cancellation charge applies, it must be disclosed and consistent with the agreement and applicable law.
Consumer cancellation rights: If you are a consumer entering into a contract online, by telephone or away from our business premises, you may have a statutory right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, subject to applicable exceptions and rules.
If you request that a service begins during that cancellation period, additional legal requirements may apply. You may have to pay a proportionate amount for services already supplied if you cancel, provided the legal conditions are satisfied. You may lose the right to cancel for a service fully performed during that period only where the applicable legal requirements have been met, including any required express request and acknowledgement.
Certain contracts or circumstances may be subject to different rules or exceptions. We will provide the required cancellation information where applicable.
Nothing in this section removes any statutory cancellation right you may have.
10. Customer complaints and service concerns
If you are dissatisfied with a cleaning service, please contact us as soon as reasonably possible at info@lerhema.com.
Please provide your name, booking details, the date of the service and a description of the concern. Photographs or other relevant information may help us assess the issue.
We will review the information and discuss an appropriate response, which may include clarification of the agreed scope, a reasonable opportunity to address an identified service issue or another remedy where appropriate.
Any complaint procedure or time limit will not remove a customer's statutory rights.
11. Damage, loss and liability
Customers should inform us promptly if they believe our work has caused damage or loss.
We will consider reported incidents fairly and assess the relevant circumstances, evidence and applicable contractual and legal obligations.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
For business customers, and only to the extent permitted by law, any agreed limitation of liability should be expressly stated in the applicable business contract.
For consumers, we do not exclude or restrict statutory rights or liability where the law prohibits doing so.
We are not responsible for pre-existing damage or defects merely because they are discovered during or after a cleaning service. However, this does not remove any liability that arises where we have caused or contributed to the damage.
12. Property access, keys and security
Where access arrangements require keys, access codes or other security information, the parties should agree the relevant arrangements before the service.
Customers should provide only the access information necessary for the agreed service.
We will handle any access information received in accordance with applicable security and data protection obligations.
13. Website use and intellectual property
The content on our website, including text, branding, graphics, photographs and other materials, is owned by us or used under permission or licence, unless otherwise stated.
You may view the website and use its content for personal or legitimate business enquiries. You must not reproduce, republish or commercially exploit protected materials without appropriate permission, except where permitted by law.
You must not misuse the website, attempt unauthorised access, introduce malicious software or interfere with its operation.
We aim to keep website information accurate and current but cannot guarantee that every page will always be complete, uninterrupted or free from error.
14. Third-party websites
Our website may contain links to websites or services operated by third parties. These links are provided for convenience or information.
We do not control third-party websites and are not responsible for their content or practices. Your use of a third-party service may be subject to that provider's terms and privacy policy.
15. Franchise enquiries and opportunities
Information on our website about franchises or business opportunities is for general information and enquiry purposes unless expressly stated otherwise.
Submitting a franchise enquiry does not guarantee acceptance, appointment, territory allocation, earnings or the grant of a franchise.
Any franchise relationship will be governed by a separate written franchise agreement and applicable law. Prospective franchisees should carefully review the relevant commercial terms, fees, obligations, risks and any representations made to them before entering into an agreement.
Nothing in these website terms substitutes for a separate franchise agreement.
16. Employment enquiries
Information on our website about employment or recruitment is for general information unless a specific vacancy or offer states otherwise.
Submitting an application does not guarantee employment. Any employment relationship will be subject to the relevant employment contract and applicable law.
17. Privacy and cookies
We process personal information in accordance with our Privacy Policy.
Our website may use cookies or similar technologies. Please refer to our Cookie Policy for details of the technologies used and how to manage your preferences.
18. Events outside our reasonable control
Where an event outside our reasonable control prevents or materially delays performance, we will take reasonable steps to inform affected customers and discuss an appropriate solution.
This clause does not remove consumer rights, refund entitlements or other legal protections that apply in the circumstances.
19. Changes to these terms
We may update these website terms from time to time.
The version in force when a customer enters into a service contract will normally govern that contract unless a valid variation is agreed or the law requires otherwise.
Changes to existing service contracts must be made in accordance with the relevant agreement and applicable law.
20. Governing law and jurisdiction
These website terms and any dispute concerning them will be governed by the law of England and Wales, subject to any mandatory consumer protections that apply.
Where a customer is a consumer, nothing in this clause removes any right to bring proceedings in a court that has jurisdiction under applicable law.
For services or contracts with a different legal connection, the applicable mandatory legal rules will continue to apply.
